These Terms of Service ("Terms") govern your access to and use of FitnessExecute (the "Service"), operated by Chad Justin Enterprises LLC ("Chad Justin Enterprises," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement and that the information you provide is accurate.
FitnessExecute provides personalized training plans and coaching content generated in part by AI. The Service is for informational and fitness purposes only and is not medical advice. Consult a qualified healthcare professional before beginning any training program, especially if you have a medical condition, injury, or are pregnant. You assume all risk associated with physical activity. Stop training and seek medical attention if you experience pain, dizziness, or other concerning symptoms.
You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at chad@chadjustinenterprises.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
You agree not to:
Training plans, coaching messages, and other outputs may be generated by AI systems. These outputs are provided as-is and may contain errors or omissions. Use your judgment and consult a professional before acting on any recommendation.
The Service, including its content, branding, software, and design, is owned by Chad Justin Enterprises LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You retain ownership of data you submit (goals, stats, feedback), and you grant us a license to use it to operate and improve the Service.
Paid features, if offered, are billed according to the plan you select at checkout. Fees are non-refundable except where required by law. We may change pricing with reasonable notice. During any free or beta period, the Service is provided without charge and may be modified or discontinued at any time.
You may delete your account at any time from Settings → Account. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE ANY SPECIFIC FITNESS RESULT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAD JUSTIN ENTERPRISES LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100 USD.
You agree to indemnify and hold harmless Chad Justin Enterprises LLC from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
These Terms are governed by the laws of the United States and the state in which Chad Justin Enterprises LLC is organized, without regard to conflict of laws principles. Disputes will be resolved in the state or federal courts located in that jurisdiction, and you consent to their exclusive venue.
We may update these Terms from time to time. Material changes will be communicated by email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
